Terms of Service

These Terms of Service ("Terms") govern your use of hivideostudio.com (the "Service"), operated by Ye Zheng, an individual sole proprietor based in Hong Kong SAR ("we", "us"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. The Service

HiVideoStudio lets you create AI-generated videos by applying effects and models to photos and prompts you provide. Generation is performed by third-party AI model providers accessed through fal.ai. Results are produced automatically, can vary, and may not always match your expectations.

2. Accounts

You must be at least 18 years old to use the Service. You can sign in with Google or with an email address and password. You are responsible for keeping your credentials secure and for all activity on your account. Provide accurate information and tell us if you suspect unauthorized use.

3. Credits, packs and subscriptions

  • Generations consume credits. The number of credits each effect or model costs is shown before you generate.
  • Credit packs are one-off purchases. Credits from packs do not expire.
  • Subscriptions renew automatically each month and add credits each billing period until you cancel. Subscription credits reset at the start of each billing period and do not roll over. Credits from packs never expire.
  • You can cancel a subscription at any time before it renews; it stays active until the end of the current paid period and is not renewed after that.
  • If a generation fails or is blocked by moderation, the credits it used are returned to your balance automatically.
  • Prices are shown at checkout, including the currency. All prices are in US dollars (USD) and exclude tax; applicable taxes may be added at checkout. Payments are processed by Stripe.
  • Credits have no cash value, are not transferable, and can only be used on the Service. Refunds are covered by our Refund Policy.

4. Content rules

You may only upload content that you own or have all the rights and permissions needed to use. You must not upload, or use the Service to create:

  • any image or video depicting a minor (anyone under 18);
  • anyone's likeness without their consent, including deepfakes intended to deceive, harass, defame or impersonate;
  • celebrities, public figures or other recognizable people unless you have the rights to use their likeness;
  • nudity, sexual or pornographic content (NSFW), or sexualized content of any kind;
  • violent, hateful, harassing or illegal content, or content that infringes copyright, trademark, privacy or publicity rights;
  • content intended for fraud, scams, misinformation or political manipulation.

We and our providers use automated moderation and may block generations, remove content, or suspend or close accounts that break these rules, without refund for credits consumed by violating requests. We may report illegal content to the authorities.

5. Your content and outputs

You keep ownership of what you upload. You grant us a limited license to store, process and transmit your uploads and outputs only as needed to operate the Service for you (including sending them to our AI model providers). Subject to these Terms and the terms of each underlying model provider, you may use the videos you generate for personal and commercial purposes. You are responsible for how you use your outputs. Uploads and outputs are deleted automatically after the retention period described in our Privacy Policy, so download anything you want to keep.

6. Acceptable use

Do not misuse the Service: no attempts to bypass moderation or credit limits, reverse engineer, scrape, overload, resell access, or use automated means to access it without our permission.

7. Third-party services

The Service relies on third parties including Cloudflare, fal.ai and its model providers, Stripe and Google. We are not responsible for their outages or their own terms, which may also apply to you.

8. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, including about the accuracy, quality or availability of outputs, or that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or loss of data, profits or goodwill. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 3 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

10. Indemnity

You agree to indemnify us against claims arising from content you upload or generate, or from your breach of these Terms.

11. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access if you breach these Terms or if required by law. If we close the Service or your account without cause, we will refund unused purchased credits.

12. Changes

We may update these Terms. Material changes will be posted here with a new date and, where appropriate, notified by email. Continued use after changes take effect means you accept them.

13. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong SAR have exclusive jurisdiction over any dispute, without affecting any mandatory consumer rights you have where you live.
